Terms & Conditions of Use

1.1 Acceptance of Terms: By downloading, accessing, browsing, registering for, or utilizing any services provided on StayHub India (“Platform”, accessible via stayhubindia.com, associated web sub-domains, and the StayHub Android/iOS mobile applications), you (“User”, “You”) agree to be legally bound by these Terms and Conditions of Use (“Terms”). If you do not agree to every clause contained herein, you must immediately discontinue all use of the Platform.

1.2 Contracting Entity: The Platform is owned, developed, and operated under the brand StayHub India, with its principal operating headquarters located in Meerut, Uttar Pradesh, India.

1.3 Eligibility Criteria: You represent and warrant that you are at least 18 (eighteen) years of age and possess the legal competence and capacity to enter into binding contractual obligations under the Indian Contract Act, 1872. Use of the Platform by minors is strictly prohibited unless supervised directly by a lawful guardian.

2.1 IT Act 2000 Intermediary Status: StayHub functions strictly and exclusively as an “Intermediary” as defined under Section 2(1)(w) of the Information Technology Act, 2000and governed by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

2.2 No Principal-Agent Relationship: No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created between StayHub and any User (whether Owner or Tenant). All tenancy agreements, rental contracts, rent receipts, and physical agreements are entered into solely and directly between Owner and Tenant.

3.1 Mobile OTP & Email Authentication: Access to contact owner details, publish listings, or save favorites requires authentication via verified Indian mobile numbers (via SMS One-Time Password) or official OAuth providers (Google Sign-In). You agree to provide current, truthful, and accurate information.

3.2 Single Identity & Account Confidentiality: Each User is permitted one active account. You are solely responsible for maintaining the confidentiality of OTPs, login tokens, and device credentials. Any activity originating from your verified account shall be deemed authorized by you.

3.3 Location-Based Listing Verification: To ensure listing accuracy and combat phantom properties, StayHub utilizes browser and device geolocation APIs to cross-verify the owner's physical presence or property coordinates. Falsification of geographic coordinates constitutes a material breach and triggers permanent termination.

StayHub provides discovery infrastructure exclusively for genuine residential accommodations. The platform supports the following categories across supported Indian cities:

Every user publishing a listing (“Owner”) makes the following binding representations and warranties:

Tenants and room seekers acknowledge that StayHub is an informational conduit. Tenants assume full responsibility for exercising prudence and due diligence:

7.1 No Escrow or Payment Intermediation: StayHub does not operate a payment gateway for tenancy rents. StayHub shall not be a party to any financial dispute, chargeback, unauthorized transfer, or failure to return security deposits between Owners and Tenants.

7.2 Fraud Warning: If any party claiming to be an employee, agent, or representative of StayHub demands advance deposit transfer to a “StayHub corporate account” or “StayHub QR code”, it is fraudulent. Report it immediately to support@stayhubindia.com.

7.3 Zero Brokerage Model: StayHub operates on a zero-brokerage model for basic discovery. StayHub does not deduct any percentage commission from monthly rents.

In accordance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Users shall not host, display, upload, modify, publish, transmit, or share any information that:

• Belongs to another person and to which the user does not have any legal right.
• Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, or racially/ethnically objectionable.
• Infringes any patent, trademark, copyright, or proprietary proprietary intellectual property rights.
• Deceives or misleads the addressee about the origin of the message or knowingly communicates any misinformation.
• Impersonates another person or uses stolen identification credentials.
• Contains software viruses, Trojan horses, worms, or any other computer code designed to disrupt services.
• Threatens the unity, integrity, defense, security or sovereignty of India, or friendly relations with foreign States.

8.1 Takedown Rights: StayHub reserves the unconditional statutory right, upon receiving actual knowledge or a court order / government directive, to disable access to or remove infringing content within 36 (thirty-six) hours, and permanently suspend the perpetrator's account.

9.1 “As-Is” and “As-Available” Service: The Platform, its search features, and all listing directories are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. StayHub does not guarantee uninterrupted uptime, uninterrupted server availability, or absolute completeness of listings.

9.2 Exclusion of Consequential Damages: To the fullest extent permitted by Indian law, StayHub, its founders, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, loss of rental income, loss of data, property damage, personal injury, theft, or emotional distress arising out of transactions arranged between Users.

9.4 User Indemnification: You agree to indemnify, defend, and hold harmless StayHub, its officers, directors, and employees from and against any third-party claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, misrepresentation of property title, unlawful tenancy conduct, or violation of applicable laws.

10.1 Substantive Law: These Terms shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India, without reference to conflict of law principles.

10.3 Informal Resolution First: Prior to instituting any formal litigation, the User agrees to submit a written statement of dispute to the Grievance Officer and engage in good-faith informal negotiations for a minimum duration of 30 (thirty) business days.
